STATUTE
l. GENERAL CLAUSES
The Youth Organization of Belarusian-American Association, (hereinafter referred to as “the Organization”), is an entity, which, on a voluntary basis, unites young people, who consider Belarus their Motherland or consider themselves as Belarusians and aim to preserve the Belarusian identity following emigration. In its activity, the Organization conforms to the principles of the independence of Belarus.
The coat of arms "Pahonia" ("Chase"), white-red-white flag and Belarusian language are sacred for the Organization. The Organization exists within the territory of the United States, according to the USA’s legislation. The main part remains unchanged.
2. GOALS AND WAYS OF ACHIEVEMENT
GOALS
The Preservation of cultural identity while living abroad. The elimination of the consequences of Russian and Polish oppression among the new emigrants, as well as in the Belarusian environment. Consolidation of Belarusians for further development, spiritual preservation, (and the corresponding avoidance of decline), preservation of national values for the strengthening of national forces.
The dissemination of true information about history, culture and modern life of Belarusians. The supply of multifaceted aid to young Belarusian emigrants in their adaptation to the new environment. Assistance to young Belarusians in the acquiring of education and jobs, which will facilitate the new emigrants’ attainment of a solid material base, which, in turn, will strengthen the existing Belarusian Diaspora.
The development of capable substitutes for retiring members of the older generation, who will become responsible for the preservation of Belarusian property. Practicing sport activities to raise the moral and physical condition of Belarusian individuals.
MEANS OF GOAL ACHIEVEMENT
The investigation and promotion of Belarusizm and true Belarusian history by meetings with experienced intellectuals.
The pursuit of cultural and enlightening activity including: recreation trips, organization of Belarusian events, visiting of museums and exhibitions.
The development and support of relations between Belarusians in the USA.
The development and strengthening of contacts with other emigrant organizations of Belarusians.
The collection and organization of funds for the implementation of goals, as well as the establishment of Mass Media (Web-sites, newspapers, information bulletins).
3. MEMBERSHIP IN THE ORGANIZATION
To be a member of the Organization the candidate must be an individual (of legal capacity), who shares the goals of the Organization and recognizes and implements its Statute. A member must be between the ages of 16 and 33.
Fluency in the Belarusian language is a prerequisite for membership in the Organization, (for the individuals, who do not know Belarusian on the appropriate level, a trial period of language study is permitted). Each application for membership is considered and resolved by the Council.
Membership in the Organization is possible after attending three meetings and with the recommendation of one member, (in exceptional cases membership may be obtained is possible after attending two meetings).
A member of the Organization cannot be the member of other organization, the goals of which contradict the goals of our Organization. Also, any individual, who participated in the repressions and persecutions of Belarusians and against Belarusizm or a Belarusian, or an individual who may cause moral damage to the Organization, will be ineligible for membership.
A decision, concerning the joining the Organization is made after the written request of the applicant and is taken at the meeting of the Council. A decision regarding expulsion from the Organization
Membership may be suspended in the following cases:
- Voluntary request;
- Non-fulfillment of the Statute;
- Use of the position in the Organization for the purpose of self-interest;
- Actions, which caused material and moral damage to the Organization;
- In case of the cessation of the Organization activity;
The decision, concerning expulsion from the Organization, is made at meetings of the Council. In exceptional cases, the decision is made by the Chairman, with the right to appeal the decision at the meeting of the Council.
A member of the Organization is entitled to:
- Criticize any of the Organization members;
- Acquire assistance in any of questions (the assistance may be rendered in the form of experience exchange);
A member of the Organization is obliged to:
- Obey the requirements of the Statute;
- Assist in the implementation of Organization goals;
- Popularize the history and culture of Belarus;
- Obey the decisions of the Council and Chairman.
4. GOVERNING BODIES
The supreme governing body is the General Meeting, which may be called if necessary, but meets at least once a year.
Information about an upcoming meeting shall be disseminated not later than 30 days before the meeting.
All members of the Organization must be informed of an upcoming General Meeting twice, as a precondition to holding such a meeting.
Decisions may be accepted at the General Meeting on the principle of simple majority. The General Meeting is conducted according to the program, composed and adopted by the session of the Council and shall consider all the interests and wishes of the members of the Organization.
During the period between the General Meetings, governing functions are implemented by the Council, managed by the Chairman.
Council:
- Develops a plan of the activities of the Organization;
- Executes accepted decisions;
- Specifies the volume and schedule of membership contributions.
Chairman:
- Term of authority - 1 year;
- Directs the meetings of the Council, according to the accepted plan of the meeting;
- Keeps a record of the meetings' protocol and carries out general record management functions;
- Manages the current activity of the Organization;
- Takes responsibility for relations with the older Belarusian organizations.
Vice-chairman:
- Term of authority - 1 year;
- Directs the meetings of the Council in the absence of the Chairman;
- Takes responsibility for the dissemination of the decisions of the Council among the members of the Organization.
Treasurer:
- Term of authority - 1 year;
- Collects and registers the financial resources, carries out accounting procedures of the financial resources of the Organization;
- Implements the Budget;
- Provides regular reports concerning the financial standing of the Organization.
Revision Commission:
- Implements control over the execution of the Statute;
- Controls the expenditure of financial resources.
The work language of the meetings and meetings of the Council is Belarusian.
The language of documentation is Belarusian. If necessary, the appropriate documents may be translated into English. The decisions, accepted at the meeting are written to conform to the Protocol and published on the Web-site.
The Organization may have regional branches. The decisions, accepted at the meetings of the Council, are carried out by persons, responsible for their implementation. The report on the implementation is heard at the meeting of the Council and published on the Web-site.
5. FINANCIAL RESOURCES
The financial resources of the Organization are collected from:
- Members' contributions;
- Charitable donations;
- Earnings from organized events;
- Other legal events.
The guiding principle of the use and collection of financial resources are transparency and justice. Inputs and debits shall be registered in two separate books, sealed by three members of the Revision Commission.
6. SYMBOLS AND ATTRIBUTES
The Organization may have its symbols and attributes (such as membership card, seal, coat-of-arms). The use of the Organization symbols and attributes shall be strictly reasoned to prevent possible misuse.
7. CESSATION OF ACTIVITY
The Organization may be liquidated, by a decision of the General Meeting with a required quorum of 3\4 participants' votes, who voting in favor of liquidation.
The financial resources, which remain after the liquidation, will be used, according to the decision of the Liquidation Commission, made up of Organization members.
